By creating an account, registering, or using SpiceKart Services, you expressly consent to receive authentication and security-related communications from SpiceKart for the purpose of account verification, access, and protection. These communications are strictly limited to: One-time passcodes (OTP), Login verification messages, Password reset instructions, Account security alerts and fraud prevention notices.

These communications are non-promotional and necessary for account functionality and security. You agree that SpiceKart may send authentication and security communications via: SMS (text messaging) and Email.

By providing your contact information and opting in, you acknowledge and agree that:

3.2 No Opt-Out for Security Messages

Disabling receipt of these messages may limit or prevent access to your account.
If you do not wish to receive these messages, you must request account closure.

SpiceKart will only send promotional or marketing communications via separate email addresses intended for marketing and promotions. Marketing communications may include:

Special offers and discounts.
Subscription promotions.
Product recommendations.
Seasonal deals and campaigns.
Service updates not related to your specific orders or account security.

4.1 No Condition of Purchase

Your consent to receive marketing communications:

Is voluntary.
Is not required to purchase or use SpiceKart Services.
Does not affect your ability to receive service or authentication messages.

You are responsible for ensuring that your contact information is accurate and up to date. SpiceKart is not responsible for:

Missed notifications.
Failed authentication attempts.
Delivery or account access issues caused by incorrect contact details.

5. Third-Party Retail Stores and Service Providers

SpiceKart LLC operates solely as a grocery ordering and delivery service provider. Products may be sourced from independent retail stores, supermarkets, wholesalers, specialty stores, and third-party merchants.

To facilitate shopping and delivery services, we may share limited information with participating retail stores and service providers, including customer names, delivery addresses, order details, and delivery instructions necessary for order fulfillment.

We may also work with third-party companies that assist with payment processing, cloud storage, analytics, logistics, customer support, marketing, and security services.

6. Payment Information

Payments are processed by third-party payment processors like Stripe. SpiceKart LLC does not store complete credit or debit card numbers or other payment card details on its servers.

7. Subscription and Recurring Billing

By subscribing to our services, you authorize SpiceKart LLC and its payment processors to charge recurring subscription fees, delivery fees, taxes, tote replacement fees, and other authorized charges to your payment method on file.

8. Thermal Tote Bag Recovery Charges

Reusable insulated thermal tote bags may be provided with customer orders. Customers agree to return tote bags during the next scheduled delivery.

If tote bags are not returned after several reasonable collection attempts, SpiceKart LLC reserves the right to charge a replacement fee of $4.00 per bag to the customer’s payment method on file.

9. Cookies and Tracking Technologies`

We may use cookies, analytics tools, pixels, and similar technologies to remember preferences, authenticate users, improve Platform performance, and deliver promotional content.

10. Marketing Communications

We may send promotional emails, text messages, or notifications regarding subscriptions, discounts, products, and services. Users may opt out of marketing communications at any time.

We retain personal information as reasonably necessary to provide services, maintain operations, comply with legal obligations, resolve disputes, enforce agreements, and prevent fraud.

Accounts must be created and managed by a parent or legal guardian.
Minors are not permitted to create accounts, place orders, or manage subscriptions.

The account holder is fully responsible for all activity conducted through their account, including use by any household members.

The Platform may contain links to third-party websites or services. SpiceKart LLC is not responsible for third-party privacy practices or content.
